General terms and conditions of sale

1. Presentation and Scope

These General Terms and Conditions of Sale (GTC) define the rights and obligations of Facile Solution SRL (hereinafter "the Publisher") and the customer (hereinafter "the Customer") regarding the sale of products offered on the website Gemmose.com (hereinafter "the Site").

These Terms and Conditions are accessible on the Website and may be modified at any time. Any modification will be communicated to the Customer before an order is validated.


2. Definitions

  • Customer : Any natural person aged at least 18 years, placing an order on the Site for strictly personal use.
  • Product(s) : Items offered for sale on the Site.
  • Order : Purchase of Products made on the Site by the Customer.
  • Withdrawal form : Document enabling the Customer to exercise their right of withdrawal, attached as an appendix to these Terms and Conditions.
  • Editor : Facile Solution SRL, operator and publisher of the Site.

3. Product Characteristics

The main characteristics of the Products (description, price, images) are detailed on the Site in their respective listings.

Availability :

  • Products are sold while stocks last.
  • In case of unavailability, the Customer will be informed by email and refunded within 30 days.

4. Geographic Area

Orders and deliveries are limited to mainland France, Belgium, Luxembourg, and Switzerland. Any orders outside this area cannot be fulfilled.


5. Ordering Process

  1. Add to Cart

    • The Customer selects the desired Products and adds them to their basket.
  2. Identification

    • The Customer must create an account or log in to validate their order.
  3. Order Confirmation

    • Before finalizing the order, the Customer must verify the information entered, accept these Terms and Conditions, and then make the payment via a secure platform.
  4. Order Confirmation

    • A written confirmation is sent by email as soon as the order is validated.
    • An additional email will notify you of the shipment of the Products.

6. Price and Payment

  • Price Prices are shown in euros, including all taxes (TTC).
  • Payment Methods :
    • Payment by bank card (CB, Visa, MasterCard).
    • Other payment methods, such as PayPal or American Express, are not accepted.
  • Security Payments are made via a secure third-party platform. The Client's bank details are never stored by the Publisher.

7. Delivery

  1. Delivery Methods

    • Delivery is deemed to have taken place when the package is handed over to the Customer or to a designated third party.
  2. Time limit

    • All orders are shipped within 48 hours.
    • The estimated delivery time is between 4 and 6 working days from the date of order shipment.
    • If the deadline is exceeded by more than 30 days, the Customer may cancel the order and obtain a full refund.
  3. Reservations and Claims

    • The Customer must check the condition of the package upon receipt and report any anomaly (open, damaged package) within 3 working days following delivery, by registered letter addressed to the carrier with a copy to the Publisher.
  4. Delivery Fees

    • Delivery costs are specified during order confirmation.

8. Right of Withdrawal

In accordance with Articles VI.47 et seq. of the Economic Law Code, the Customer has a right of withdrawal under the following conditions.

Deadline for notifying withdrawal

The Customer has a period of 14 days from the date of receipt of the Product to notify their decision to withdraw from the contract, without having to justify their decision or bear any costs other than those provided for by law.

Terms and conditions

To exercise their right of withdrawal, the Customer may:

either use the official withdrawal form template;

or use the template available in Appendix 1; 
or send the Publisher any other unambiguous statement expressing their wish to withdraw (by email, post, or telephone).

Use of the form is not mandatory.

Returning Products

  • To notify the company of their wish to withdraw, Customers have a period of 14 days from delivery (Art. VI.47, §2, 2° CDE).
  • To return the goods, the Customer has a further period of 14 days from the day on which they notify the company of their decision to withdraw (Art. VI.51, §1, para. 1 CDE).
  • If the consumer withdraws, the company shall refund all payments received from the consumer, including delivery costs (Art. VI.50, §1, para. 1 CDE).
  • The return costs shall be borne by the Customer, except in the case of a defective or non-compliant product.
  • It is recommended that a tracked delivery service be used to ensure that the return is received.
  • The company shall make the refund using the same means of payment as that used by the consumer for the initial transaction (Art. VI. 50, §1, para. 2 CDE).

Refund

  • The company has 14 days from the date on which it is informed of the consumer's decision to withdraw to refund the Customer. However, the company may defer the refund until it has received the goods, or until the consumer has provided proof of shipment of the goods, whichever is earlier (Art. VI.50, §1 para.1 and §3 CDE).
  • However, the company may defer reimbursement until it has recovered the goods, or until the consumer has provided proof of shipment of the goods, whichever occurs first (Art. VI.50 §3 CDE).

9. Guarantees

  1. Legal Guarantee of Conformity

    • Valid for 2 years from the date of delivery. The Customer may request repair or replacement of the Product.
  2. Warranty Against Hidden Defects

    • Allows you to request a refund or price reduction in case of a hidden defect.

10. Personal Data

The Client's personal data is collected and processed in accordance with the Privacy Policy.

12. Miscellaneous Provisions

  1. Evidence

    • Electronic communications between the Publisher and the Client are considered valid.
  2. Partial Validity

    • If a provision of the General Terms and Conditions is deemed invalid, the others remain applicable.
  3. Securities

    • The article titles are indicative and do not affect the interpretation of the General Terms and Conditions.

13. Disputes

These Terms and Conditions are governed by Belgian law. In the event of a dispute, the Customer may:

  • Request amicable mediation.
  • To take the matter to the competent courts.
